We maximally extend the quantum‐mechanical results of Muller and Saunders ( 2008 ) establishing the ‘weak discernibility’ of an arbitrary number of similar fermions in finite‐dimensional Hilbert spaces. This confutes the currently dominant view that ( A ) the quantum‐mechanical description of similar particles conflicts with Leibniz’s Principle of the Identity of Indiscernibles (PII); and that ( B ) the only way to save PII is by adopting some heavy metaphysical notion such as Scotusian haecceitas or Adamsian primitive thisness. This is a transcript of a conversation between P F Strawson and Gareth Evans in 1973, filmed for The Open University. Under the title 'Truth', Strawson and Evans discuss the question as to whether the distinction between genuinely fact-stating uses of language and other uses can be grounded on a theory of truth, especially a 'thin' notion of truth in the tradition of F P Ramsey.

One of the reasons provided for the shift away from an ontology for physical reality of material objects & properties towards one of physical structures & relations (Ontological Structural Realism: OntSR) is that the quantum-mechanical description of composite physical systems of similar elementary particles entails they are indiscernible. As material objects, they 'whither away', and when they wither away, structures emerge in their stead. We inquire into the question whether recent results establishing the weak discernibility of elementary particles pose a (...) threat for this quantum-mechanical reason for OntSR, because precisely their newly discovered discernibility prevents them from 'whithering away'. We argue there is a straightforward manner to consider the recent results as a reason in favour of OntSR rather than against it. (shrink)

I begin by criticizing an elaboration of an argument in this journal due to Hawley , who argued that, where Leibniz’s Principle of the Identity of Indiscernibles faces counterexamples, invoking relations to save PII fails. I argue that insufficient attention has been paid to a particular distinction. I proceed by demonstrating that in most putative counterexamples to PII , the so-called Discerning Defence trumps the Summing Defence of PII. The general kind of objects that do the discerning in all cases (...) form a category that has received little if any attention in metaphysics. This category of objects lies between indiscernibles and individuals and is called relationals: objects that can be discerned by means of relations only and not by properties. Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

Planned home birth has been considered by some to be consistent with professional responsibility in patient care. This article critically assesses the ethical and scientific justification for this view and shows it to be unjustified. We critically assess recent statements by professional associations of obstetricians, one that sanctions and one that endorses planned home birth. We base our critical appraisal on the professional responsibility model of obstetric ethics, which is based on the ethical concept of medicine from the Scottish and (...) English Enlightenments of the 18th century. Our critical assessment supports the following conclusions. Because of its significantly increased, preventable perinatal risks, planned home birth in the United States is not clinically or ethically benign. Attending planned home birth, no matter one’s training or experience, is not acting in a professional capacity, because this role preventably results in clinically unnecessary and therefore clinically unacceptable perinatal risk. It is therefore not consistent with the ethical concept of medicine as a profession for any attendant to planned home birth to represent himself or herself as a “professional.” Obstetric healthcare associations should neither sanction nor endorse planned home birth. Instead, these associations should recommend against planned home birth. Obstetric healthcare professionals should respond to expressions of interest in planned home birth by pregnant women by informing them that it incurs significantly increased, preventable perinatal risks, by recommending strongly against planned home birth, and by recommending strongly for planned hospital birth. Obstetric healthcare professionals should routinely provide excellent obstetric care to all women transferred to the hospital from a planned home birth. The professional responsibility model of obstetric ethics requires obstetricians to address and remedy legitimate dissatisfaction with some hospital settings and address patients’ concerns about excessive interventions. Creating a sustained culture of comprehensive safety, which cannot be achieved in planned home birth, informed by compassionate and respectful treatment of pregnant women, should be a primary focus of professional obstetric responsibility. Over the past years, in books and journals (this journal included), N. Maxwell launched a ferocious attack on B. C. van Fraassen’s view of science called Constructive Empiricism (CE). This attack has been totally ignored. Must we conclude from this silence that no defence is possible and that a fortiori Maxwell has buried CE once and for all? Or is the attack too obviously flawed as not to merit exposure? A careful dissection of Maxwell’s reasoning will make it clear that (...) neither is the case. This dissection includes an analysis of Maxwell’s ‘aberrance–argument’ (omnipresent in his many writings) for the claim that science implicitly and permanently accepts a substantial, metaphysical thesis about the universe, which then paves the way for his own metaphysical-realist hierarchy-view of science. This aberrance-claim, which Maxwell directs against a widely shared and harmful ideology of science called ‘Standard Empiricism’, generally has been ignored too, for more than a quarter of a century. Our conclusions will be that (i) Maxwell’s attacks on CE can be beaten off, and (ii) his ‘aberrance–arguments’ do not establish what Maxwell believes they establish, but (iii) we can draw a number of valuable lessons from these attacks about the nature of science and of the libertarian nature of CE. The quest for finding the right interpretation of Quantum Mechanics is as old as QM and still has not ended, and may never end. The question what an interpretation of QM is has hardly ever been raised explicitly, let alone answered. We raise it and answer it. Then the quest for the right interpretation can continue self-consciously, for we then know exactly what we are after. We present a list of minimal requirements that something has to meet in order to (...) qualify as an interpretation of QM. We also raise, as a side issue, the question how the discourse on the interpretation of QM relates to hermeneutics in Continental Philosophy. (shrink)

Remarkably, despite the tremendous success of axiomatic set-theory in mathematics, logic and meta-mathematics, e.g., model-theory, two philosophical worries about axiomatic set-theory as the adequate catch of the set-concept keep haunting it. Having dealt with one worry in a previous paper in this journal, we now fulfil a promise made there, namely to deal with the second worry. The second worry is the Skolem Paradox and its ensuing Skolemite skepticism. We present a comparatively novel and simple analysis of the argument (...) of the Skolemite skeptic, which will reveal a general assumption concerning the meaning of the set-concept (we call it Connexion M). We argue that the Skolemite skeptics argument is a petitio principii and that consequently we find ourselves in a dialectical situation of stalemate.Few (if any) working set-theoreticians feel a tension – let alone see a paradox – between, on the one hand, what the Löwenheim–Skolem theorems and related results seem to be telling us about the set-concept, and, on the other hand, their uncompromising and successful use of the set-concept and their continuing enthusiasm about it, in other words: their lack of skepticism about the set-concept. Further, most (if not all) working settheoreticians have a relaxed attitude towards the ubiquitous undecidability phenomenon in set-theory, rather than a worrying one. We argue these are genuine philosophical problems about the practice of set-theory. We propound solutions, which crucially involve a renunciation of Connexion M. This breaks the dialectical situation of stalemate against the Skolemite skeptic. (shrink)

In his newly updated version of The Anatomy of a Constitutional Law Case, Alan F. Westin provides a documentary portrait of historically important constitutional law case, 'Youngstown Sheet & Tube Co. v. Sawyer, ' from its rise in a bargaining dispute in the steel industry during 1952 to the aftermath of its decision by the United States Supreme Court. Westin has added to his classic book additional materials and personal commentaries collected since the work was first published. The new information (...) covers what went on within the Truman administration, what went on within the Supreme Court when analyzing and resolving issues that come before it. Westin includes selections from transcripts, briefs and other official proceedings, adds notes describing each phase of the constitutional process, and a section of commentary and questions relating this case to others. In this journal, Brogaard and Marlow recently argued that the relativity of simultaneity is an illusion. We claim their argument is fallacious.

Despite his impressive influence on nineteenth-century philosophy, F. A. Trendelenburg's own philosophy has been largely ignored. However, among Kant scholars, Trendelenburg has always been remembered for his feud with Kuno Fischer over the subjectivity of space and time in Kant's philosophy. The topic of the dispute, now frequently referred to as the ?Neglected Alternative? objection, has become a prominent issue in contemporary discussions and interpretations of Kant's view of space and time. The Neglected Alternative contends that Kant unjustifiably moves from (...) the claim that we have a priori intuitions of space and time to the sceptical conclusion that space and time are exclusively subjective. Most current discussions trace the objection back to Trendelenburg and often use him to motivate the objection. However, to date Trendelenburg's actual arguments and reasons for rejecting the Kantian view of space and time have not been sufficiently uncovered; my goal here is to fill this lacuna. By better understanding what Trendelenburg actually argued, we will be in a better position to assess whether the Neglected Alternative objection against Kant is successful. But in addition, Trendelenburg's own system is of independent philosophical interest, and my work here will shed light on one part of it. (shrink)

We discuss the case against Factorism, which is the standard assumption in quantum mechanics that the labels of the $$\otimes$$ ⊗ -factor Hilbert-spaces in direct-product Hilbert-spaces of composite physical systems of similar particles refer to particles, either directly or descriptively. We distinguish different versions of Factorism and argue for their truth or falsehood. In particular, by introducing the concepts of snapshot Hilbert-space and Schrödinger-movie, we demonstrate that there are Hilbert-spaces and $$\otimes$$ ⊗ -factorisations where the labels do refer, even descriptively, (...) to similar particles, which renders them probabilistically absolutely discernible. L'étude aborde la question de la méthode théologique, en considérant sa nature et sa typologie, ses possibilités et ses limites, ainsi que les conditions de sa légitimité devant les instances du «depositum fidei». On attribue une importance spéciale à la tension de fond entre l'usage de la méthode kérygmatique et de la méthode dialogale dans la théologie du passé, mais surtout dans le débat actuel, spécialement entre divers courants de la théologie de la transcendance, telles les «théologies de la parole» (...) et la «méthode de corrélation», ou encore entre les «théologies du mystère» et la «méthode transcendantale». Pareille tension s'aggrave dans les «théologies de l'immanence», telles les théologies de la «mort de Dieu» ou les «théologies de l'histoire», ou entre les «théologies de la modernité» et certaines «théologies de la praxis». A la fin de ce panorama du pluralisme méthodologique actuel, on formule certains principes fondamentaux sur le problème débattu. The article investigates the language of the faith of the Church on the mystery of God. It analyzes its origin and typology, its specificity and ecclesial meaning, its ecumenical relevance, its logical coherence and its theological actuality. It follows the definitions and declarations of the Magisterium while placing the doctrine within the bi-millennial history of Trinitarian theology. The study underlines the importance for the unity of the Church of the formulation of the faith which in adoring the inseparable Trinity proclaims (...) the Holy Monarchy - origin of the divine life and of the sacramental economy - of the eternal, unbegotten Father, principle of the whole deity. After having followed the efforts made by the first apologists to sketch out the language of the ineffable mystery, and the various models of trinitarian language, the study exposes the language used by the councils in East and West: Nicea I and II, Constantinople I to III, Lateran I to IV, Lyons II to Florence, Vatican I to II, so as better to formulate the principles which articulate the rule of faith of the Church. The logic of the ecclesial language is resumed in propositions concerned with the main affirmations of faith and the proclamation of the mystery. The first propositions treat the knowability of the mystery, the possibility of its verification and the dialectic of its language. We inquire into the question whether the Aristotelean or classical \emph{ideal} of science has been realised by the Model Revolution, initiated at Stanford University during the 1950ies and spread all around the world of philosophy of science --- \emph{salute} P.\ Suppes. The guiding principle of the Model Revolution is: \emph{a scientific theory is a set of structures in the domain of discourse of axiomatic set-theory}, characterised by a set-theoretical predicate. We expound some critical reflections on the Model Revolution; the conclusions (...) will be that the philosophical problem of what a \emph{scientific theory} is has \emph{not} been solved yet --- \emph{pace} P.\ Suppes. While reflecting critically on the Model Revolution, we also explore a proposal of how to complete the Revolution and briefly address the intertwined subject of \emph{scientific representation}, which has come to occupy center stage in philosophy of science over the past decade. In a recent issue of this journal, P.E. Vermaas ([2005]) claims to have demonstrated that standard quantum mechanics is technologically inadequate in that it violates the 'technical functions condition'. We argue that this claim is false because based on a 'narrow' interpretation of this technical functions condition that Vermaas can only accept on pain of contradiction. We also argue that if, in order to avoid this contradiction, the technical functions condition is interpreted 'widely' rather than 'narrowly', then Vermaas, argument for (...) his claim collapses. The conclusion is that Vermaas' claim that standard quantum mechanics is technologically inadequate evaporates. (shrink)
